1. Scope
1.1. These General Terms and Conditions apply to all contracts, deliveries and services between the visual artist (hereinafter referred to as "artist") and his customers (hereinafter referred to as "customer").
1.2. Any differing terms and conditions of the customer will not be recognized unless the artist expressly agrees to their validity in writing.
2. Subject matter of the contract
2.1. The subject of the contract is the creation, sale or licensing of artworks, prints or commissioned works by the artist.
2.2. The presentation of artworks on the internet, in catalogues or at exhibitions does not constitute a binding offer, but rather a non-binding invitation to the customer to submit a purchase offer.
3. Conclusion of the contract
3.1. A contract is concluded when the artist confirms the customer's order in writing (by email or letter) or delivers the goods.
3.2. In the case of commissioned work, a contract is considered concluded as soon as the artist confirms the commission in writing and, if applicable, a deposit has been received.
4. Prices and Payment Terms
4.1. All prices are total prices in euros. They do not include VAT, provided the artist is exempt from VAT according to §19 UStG (small business regulation).

5. Delivery and Shipping
5.1. Delivery is at the customer's expense and risk, unless otherwise agreed.
5.2. Delivery times will be agreed upon individually.
5.3. For deliveries abroad, additional customs duties, taxes and fees may apply, which are to be borne by the customer.
6. Retention of title
The delivered artwork remains the property of the artist until full payment is received.
7. Copyright and usage rights
7.1. The artist remains the author of all works sold or commissioned.
7.2. By purchasing an original work, the customer acquires only the material ownership of the artwork, but not the copyright usage rights (e.g., for reproduction, public exhibition or commercial use).
7.3. Any reproduction, public display or commercial use requires the express written consent of the artist.
8. Right of withdrawal / cancellation (for consumers)
8.1. Consumers have the right to withdraw from the contract within 14 days without giving any reason, provided that the purchase was made remotely (e.g. via a website or by email).
8.2. The right of withdrawal does not apply to commissioned work or personalized works that have been made according to the customer's wishes.
8.3. A written notification by email or letter to the artist is sufficient for cancellation.
9. Liability
9.1. The artist is only liable for damages caused by intentional or grossly negligent conduct.
9.2. The artist accepts no liability for minor color variations or minor deviations in shape and size that arise due to the handcrafted production process.
10. Data protection
The artist collects, processes, and uses the customer's personal data exclusively within the framework of legal regulations. Data is only shared with third parties to the extent necessary for contract fulfillment.
11. Gerichtsstand und anwendbares Recht
11.1. The law of the Federal Republic of Germany applies.
11.2. The place of jurisdiction is the artist's place of residence, provided the customer is a merchant or has no place of residence in the EU.
12. Final Provisions
Should individual provisions of these terms and conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
Im Falle einer Regelungslücke werden die Parteien eine Regelung treffen, die dem nach dem gesamten Vertragsinhalt erkennbaren Parteiwillen zur Durchsetzung verhilft.
